UNKNOWN since I have bought my 2008 bmw 328i I had one recalled fixed on my dash I have the air bag light and the brake light tire light service engine soon light on my door locks would work some times and then I had to open my car from the driver side manually then my drivers side window won't roll all the way up only half way then my car just wouldn't start out of the blue replace the starter ran for three weeks and wouldn't start again and has been sitting for a month now my passenger seat belt won't click in sometimes and my warranty is out but the recalls I have read are just what my car is doing I would like this matter to be looked in to and my car repaired at no cost its a safety issue an inconvenience and has cost me money wise extremely .

THE VEHICLE HAD ONLY RECEIVED SCUFF MARKS ON THE BUMPER, HOWEVER, ALL AIR BAGS, FRONT AND REAR, HAD DEPLOYED. THE DRIVER WAS THE ONLY PERSON IN THE VEHICLE. THE VEHICLE WAS DESIGNED TO SHUT OFF DURING ANY IMPACT THEREFORE IT WAS UNABLE TO RESTART. THE VEHICLE WAS TOWED. A POLICE REPORT WAS NOT FILED. THE CONTACT STATED THEY ONLY RECEIVED AN INJURY FROM THE AIR BAG ON THEIR RIGHT FOREARM. MEDICAL ATTENTION WAS NOT NEEDED. THE CONTACT CONTACTED THE DEALER (BMW OF LAS VEGAS 6900 W SAHARA AVE, LAS VEGAS, NV 89117; (702) 570-0279) WHO INFORMED THE CONTACT THAT THERE WERE NO RECALLS ON THEIR VEHICLE RELATING TO THE AIR BAGS. THE MANUFACTURER WAS MADE AWARE OF THE FAILURE. THE MANUFACTURER CONFIRMED THAT THE VIN WAS NOT INCLUDED IN THE RECALL AND OPENED A CASE REGARDING THE MATTER. BMW WANTS TO CHARGE 1000+ DOLLARS FOR THIS SENSOR REPAIR DUE TO THEM SAYING THIS IS AN 'UNAFFECTED VEHICLE'. WITHOUT THIS SENSOR WORKING PROPERLY, IN THE EVENT OF A COLLISION, THE PASSENGER AIRBAG COULD NOT DEPLOY WHICH CAN CAUSE SERIOUS INJURY OR DEATH. BMW REFUSES TO DO ANYTHING ABOUT THIS WITHOUT A RECALL ANNOUNCED, OR WITHOUT THOUSANDS OF DOLLARS BEING SPENT JUST FOR THE SAFETY OF MY PASSENGERS.

THE PASSENGER AIRBAG LIGHT IN MY DASHBOARD IS CONSTANTLY ON. THE CAR THINKS THAT A SMALL CHILD IS SITTING ON THE SEAT AND DISENGAGES THE AIRBAG. SO NOW THE AIRBAG IS IS COMPLETELY DISENGAGED EVEN WHEN SOMEONE IS SITTING IN THE PASSENGER SEAT. I'VE TAKEN MY VEHICLE TO BMW DEALERSHIP AND THEY CHECKED MY VIN AND SAID IT'S NOT PART OF THE RECALL AND WANT TO CHARGE ME $2000 FOR THE REPAIR. I BELIEVE MY SEAT SENSOR IS THE SAME ONE THAT IS BEING RECALLED BUT NOT ENOUGH OWNERS WITH THE SAME VEHICLE HAVE FILED A FORMAL COMPLAINT WITH NHTSA. THE TWO RECALLS THAT THE NHTSA HAS RECALLED ARE 17V-428 AND 17V-605. WHY ARE THOSE MODELS THE ONLY ONE BEING RECALLED WHEN THERE'S DEFINITE MALFUNCTION WITH THE OC3 AIRBAG SEAT SENSOR? MY CAR IS THE E93 MODEL WHICH IS THE CONVERTIBLE MODEL, I BELIEVE THAT BECAUSE THIS MODEL WAS PRODUCED LESS THAN THE 4 DOOR SEDAN AND THAT MOST PPL WITH CONVERTIBLES DON'T HAVE A PASSENGER SITTING IN THE PASSENGER SEAT. I HAVE A DAUGHTER THAT SITS IN THE PASSENGER SEAT EVERYDAY AND I BELIEVE THAT IS WHY IT MALFUNCTIONED. MY CAR IS A 2008 E93 328I. I BELIEVE THE SAME AIRBAG PASSENGER MAT SEAT SENSOR IS THE SAME ONE BMW HAS RECALLED FOR THEIR 2006 AND 2007 E90 AND E91 MODELS AS WELL AS THE 2006-2010 X3 MODELS THAT ARE BEING RECALLED. PLEASE INCLUDE THE 2008 E93 MODELS AS THESE ARE THE SAME AIRBAG SENSORS THAT NEED TO BE RECALLED.

I CONTACTED THE BMW DEALER (NORTH SCOTTSDALE BMW, SCOTTSDALE AZ) AND WAS TOLD THE PART WAS NOT AVAILABLE AND WE WOULD BE CONTACTED WHEN IT WAS RECEIVED. WE FOLLOWED UP APRIL AND WERE TOLD THE SAME THING. THE CAR WAS THEN RELOCATED TO ALABAMA IN MAY. IN JUNE WE CONTACTED THE LOCAL BMW DEALER (MOBILE BMW) AND WERE TOLD THE SAME STORY. WE FOLLOWED UP IN SEPTEMBER AND WERE TOLD, AGAIN, THE PART IS NOT AVAILABLE. THIS IS REALLY BAD GIVEN THE SAFETY CONCERNS INVOLVED. IT IS NOW 8 MONTHS SINCE RECEIVING THE ORIGINAL RECALL NOTICE AND WE STILL HAVE A POTENTIAL DEADLY ISSUE THAT BMW DEALERS IN TWO STATES ARE CONSISTENTLY IGNORING.

MY FRIEND ENDED UP DRIVING INTO THE BACK OF ANOTHER VEHICLE AT A STOP LIGHT. WE WERE DRIVING APPROXIMATELY 30 MPH. UNFORTUNATELY, MY FOREARM AND WRIST BROKE AFTER THE AIR BAGS DEPLOYED AND HIT ME. I REMEMBER CHEWING METAL DEBRIS. I REMEMBER THE PAIN THAT RADIATED FROM MY WRIST TO MY ELBOW BECAUSE OF THE AIRBAGS IMPACT. I UNDERWENT SURGERY 2 WEEKS LATER (I HAD TO WAIT FOR THE SWELLING TO SUBSIDE) I HAD 2 PLATES, 18 PINS, AND 11 SCREWS INSERTED. MY WRIST WILL NEVER BE THE SAME AGAIN. BMW HAD A RECALL ABOUT THIS ISSUE BUT IT DOESN'T COVER 2008 MODELS. I HAVE A SPORT SEAT, AND WHEN I CHECKED ONLINE, I SAW IN THE FORUMS THAT LOTS OF PEOPLE ARE HAVING THE SAME PROBLEM. I BELIEVE THIS IS A MANUFACTURING PROBLEM AND BMW SHOULD RECALL EFFECTED CARS. BECAUSE IT IS VERY IMPORTANT SAFETY ISSUE...

ON THE AFTERNOON OF NOVEMBER 10TH, WHILE DRIVING, A RED LIGHT WITH A PASSENGER RESTRAINT SYSTEM MALFUNCTION MESSAGE LIT UP ON THE DASHBOARD. I BROUGHT THE CAR INTO THE DEALER THE NEXT DAY AND THEY SAID THEY HAD TO ORDER THE PART. THEY WERE UNABLE TO TURN THE LIGHT OFF, WHICH AFFECTED MY ABILITY TO RETRIEVE TIME AND TEMPERATURE ON THE DASHBOARD READER. THEY HAD TO ORDER THE PART, WHICH WAS REPLACED ON NOVEMBER 26TH. THE PART IS CALLED SOP BATTERY SAFETY TERMINAL (BATTERY CABLE PLUS POLE). I WAS TOLD THAT THE WIRES TESTED AS "BROKEN INTERMITTENTLY." I WAS TOLD THAT WHEN THIS BATTERY CABLE WORKS CORRECTLY IT WILL SHUT OFF THE GAS PUMP SO THAT THERE WAS NO DANGER OF FIRE. I WAS CONCERNED ABOUT DRIVING THE CAR EVEN WHEN THE DRIVER SIDE SEEMED TO BE ALL RIGHT, BECAUSE IF GAS LEAKED THE WHOLE CAR WOULD BE ON FIRE, NOT JUST THE PASSENGER SIDE. SINCE THERE WAS A RECALL OF THE AIRBAG SYSTEM, I THOUGHT THIS MIGHT BE ALSO RELATED. THE DEALER SAID HE HAD SEEN THIS BEFORE ON OTHER CARS BUT HE COULD NOT SAY HOW MANY. CARS UP UNTIL THE 2007 MODEL YEAR HAVE BEEN RECALLED TO FIX THE PROBLEM, BUT BMW HAS YET TO EXTEND THE RECALL TO THE 2008 MODEL YEAR. SINCE PURCHASING THIS BMW IN FEB 2012, I HAVE HAD THIS CAR AT THE DEALER 4 TIMES ( AND ITS ONLY AUG. 2012) DUE TO AIR BAG & SEATBELT LIGHTS ON, BOTH FRONT SEATS HAVE HAD SEAT BELT PRETENSIONERS REPLACED, & VARIOUS OTHER AIRBAG WORK, FRAYED WIRES UNDER SEAT. THE PROBLEM SEEMS TO BE UNSTOPPABLE. THE CURRENT MILEAGE IS APPROX 104K MILES. THE CAR IS CURRENTLY ON ITS WAY TO THE DEALER TODAY 08/23/2012 FOR ITS 4TH TRIP -FOR THE UN-STOPPABLE AIRBAG & SEAT BELT LIGHT THAT IT SEEMS TO BE DOOMED WITH. *TR

THROUGH OUT THE PAST MONTH I HAVE HAD MY CAR TOWED THREE TIMES WITH FIVE OCCURRENCES OF THE CAR NOT CRANKING AND THE ELECTRICAL SYSTEM SHUTTING DOWN LEAVING ME STRANDED. OVER THE PAST YEAR THE AIRBAG LIGHT HAS COME ON AT LEAST ONCE A MONTH FOR LESS THAN 5-10 MINUTES AT THE TIME. THE FIRST INSTANCE IT WAS TOWED BMW OF MOBILE REPLACED THE BATTERY AFTER SEVERAL DAYS OF TROUBLE SHOOTING EVEN THOUGH I HAD OUR LOCAL POLICE DEPARTMENT CHECK THE BATTERY TO BE SURE THAT WAS NOT THE ISSUE. THEY CHARGED ME OVER FIVE HUNDRED DOLLARS FOR THIS BATTERY. TWO DAYS AFTER THE BATTERY WAS REPLACED I HAD IT TOWED AGAIN TO BMW OF MOBILE BECAUSE THE CAR WOULD NOT CRANK AGAIN AND THE LIGHTS ETC. WOULD COME ON. THEY KEPT THE CAR FOR OVER 5 DAYS RUNNING TEST THEN STATED THAT "NOTHING WAS WRONG." I TOLD THEM THAT I WOULD NOT HAVE HAD IT TOWED IF NOTHING WAS WRONG. TWO DAYS LATER IT WOULD NOT CRANK AGAIN WHEN MY 3 YEAR OLD DAUGHTER AND I WERE AT A LATE LOCAL HIGHSCHOOL FOOTBALL GAME. THIS TIME THEY SAID THAT IT WAS AN ELECTRICAL WIRE ON THE PASSENGER SIDE CAUSING THE PROBLEM CAUSING SOMETHING TO MELT NEAR THE FUSE PANEL($1,200) TO REPLACE). *TR
