The contact owns a 2003 Jaguar S-Type. The contact stated while driving approximately 20-25 MPH, the vehicle would shift into reverse independently and would lock up while the gear shifter was in a drive(D). The gear box fault warning light was illuminated. The contact depressed the accelerator pedal in order to continue to drive. Additionally, the contact stated that while at a complete stop with the vehicle in drive(D), the vehicle would reverse independently. The contact would immediately depress the brake pedal. The warning message "Gear Box Fault" was illuminated. There was no further information provided. The vehicle was taken to an independent mechanic several times where it was diagnosed that the failure was associated with NHTSA Campaign Number: 04V024000 (Power Train). The independent mechanic then contacted the local dealer who advised that the transmission control module (TCM) was previously reprogrammed under NHTSA Campaign Number: 04V024000 (Power Train) in 2004. The dealer advised that they could not assist as the software was no longer available. The vehicle was not repaired. The manufacturer was not notified of the failure. The failure mileage was approximately 120,000.

The contact owns a 2003 Jaguar S. The contact stated that his wife was reversing with the brake pedal being depressed when she lost control of the vehicle and it accelerated on its own almost crashing into pedestrians. The dealer was made aware of the failure but informed the contact that they only repair vehicles made in 2005 and newer and the VIN was not included in a recall. The vehicle was not diagnosed nor repaired. The manufacturer was not made aware of the failure. The failure mileage was 105,000. VIN was unavailable.

MY 2003 JAGUAR S-TYPE WAS RECALLED IN 2004, RECALL #42036 (R513) POWER TRAIN: AUTOMATIC TRANSMISSION. I PURCHASED MY JAGUAR AS THE SECOND OWNER 1 1/2 YEARS AGO. I HAVE HAD TROUBLE WITH THE CAR. FOR INSTANCE WHEN I ATTEMPT TO PASS ANOTHER VEHICLE ON THE HIGHWAY AND TRY TO SPEED UP THE TRANSMISSION SLOWS THE CAR DOWN SIGNIFICANTLY. IF I AM TRAVELING AT 55 M.P.H AND ACCELERATE THE CAR WILL IMMEDIATELY SLOW TO ABOUT 30 M.P.H OR LESS. IT IS VERY SCARY! AND COULD RESULT IN A CRASH (AS THE WARNING STATED ON THE RECALL)! THE REPAIR SHOP RAN A COMPUTER DIAGNOSTIC ON MY CAR. THE CODE ON THE COMPUTER STATES "THE TRANSMISSION NEEDS RE-PROGRAMMING OF THE TRANSMISSION CONTROL MODULE AS THE TRANSMISSION IS SLIPPING INTO NEUTRAL UNDER LOAD." THE SHOP SAID THERE WAS AN OPEN RECALL ON THE CAR AND THE DEALER NEEDS TO UPDATE THE COMPUTER SOFTWARE TO CORRECT THE PROBLEM. THE CAR HAS NO STICKERS SAYING RECALL SERVICE WAS EVER DONE ON IT. THE DEALER SAID THEY CANNOT PERFORM THE SERVICE UNDER THE RECALL AS THE RECALL AS THERE IS NO OPEN FIELD ACTION ON MY VEHICLE ALTHOUGH THERE IS A CURRENTLY OPEN CAMPAIGN. THE DEALER STATED THE MANUFACTURER HAS THE RECALL LISTED AS COMPLETED. IN CONTACTING THE MANUFACTURER OPENED AN INVESTIGATION STATING THE RECALL WAS COMPLETED 03/09/05. 4 DAYS LATER JAGUAR CALLED BACK AND SAID THEY NEED A LETTER OR EMAIL FROM NHTSA STATING TREAD'S RECOMMENDATION TO MANUFACTURERS TO "DIAGNOSE THE IMPAIRMENT, THUS NULLIFYING FURTHER RECURRENCE OF THE IMPAIRMENT." ARE YOU ABLE TO ASSIST ME BY GIVING ME SOMETHING IN WRITING TO GIVE TO THE JAGUAR MANUFACTURER EXPLAINING THEIR RESPONSIBILITY IN CORRECTING A RECALL AS STATED IN THE TRANSPORTATION RECALL ENHANCEMENT ACCOUNTABILITY AND DOCUMENTATION (TREAD) ACT ? I PULLED UP TO STOP AT A RESTAURANT CURB AND STOPPED THE VEHICLE. THE ENGINE SUDDENLY RACED TO APPROX 6000-6500 RPM. I WAS ABLE TO KEEP MY FOOT FIRMLY ON THE BRAKE, SHIFT THE TRANSMISSION INTO PARK, AND TURN THE ENGINE OFF. WHEN I RE-STARTED THE ENGINE EVERYTHING WAS FINE. I DID' NOT THINK TOO MUCH OF THIS, OUTSIDE OF SCARING THE HELL OUT OF ME, AS I THOUGHT MY FOOT MIGHT HAVE SLIPPED OFF THE BRAKE AND ON TO THE ACCELERATOR. ABOUT ONE WEEK IT HAPPENED AGAIN AS I WAS PULLING UP TO A STOP BEHIND A VEHICLE THE ENGINE STARTED RACING AGAIN. AGAIN I WAS ABLE TO SOP, WITHIN 2 FEET, OF THE VEHICLE IN FRONT OF ME. THE VEHICLE IS NOW AT THE JAGUAR DEALERSHIP, MARKEL, IN OMAHA, NE. JAGUAR S-TYPE SEDAN 2003 WAS SUBJECT TO RECALL R-513 BUT NOT LIMITED TO THIS. THIS VEHICLE EXPERIENCED MAJOR MALFUNCTIONS IN PERFORMANCE WITH GEAR BOX AND BRAKING SYSTEMS IN WHICH IT COULD NOT BE PROPERLY SHIFTED OUT OF PARK, LOST RPM, PARKING BRAKE FAILURE, ABS WARNING LIGHTS AND MAJOR ENGINE LIGHT INDICATOR WARNINGS. THE CAR COULD NOT BE SAFELY DRIVEN AND SUFFERED A MAJOR BREAKDOWN WITH LESS THAN 9500 MILES, FLATBEDDED TO SPORTIQUE MOTORS IN HUNTINGTON, NY ON 12/10/2004, RETURNED ON 12/15/2004 ONLY TO BE FLATBEDDED AGAIN ON 12/17/2004. A NEW COMPUTER WAS NOT INSTALLED IN THE VEHICLE AS PROMISED AT THAT TIME, AND THE COMPUTER WAS SIMPLY REFLASHED. AT 33,948 MILES OUT OF WARRENTY ON MAY 26, 2010 THIS VEHICLE SUFFERED THE SAME MAJOR BREAKDOWN AS DESCRIBED ABOVE AND WAS AGAIN FLATBEDDED TO HUNTINGTON LAND ROVER JAGUAR, FORMERLY SPORTIQUE JAGUAR, HUNTINGTON, NY. THE CAR COULD NOT PROPERLY BE SHIFTED OUT OF PARK, LOST RPM AND COULD NOT BE DRIVEN SAFELY.THE DEALERSHIP WORKED ON THE CAR FOUR (4) TIMES DECLARING THE PROBLEM SOLVED ON THREE OCCASIONS FROM MAY 26, 2010 UNTIL IT WAS FLAT BEDDED BACK A FORTH TIME ON 07/22/10 ONLY TO BE TOLD THE CAR NEEDED A NEW "PARK SENSOR MODULE" AND NEW "TRANSMISSION SENSOR" AT A COST OF OVER $4000 DOLLARS WITH LABOR. MY ATTEMPTS TO OBTAIN ASSISTANCE FROM JAGUAR CENTRAL AND HUNTINGTON JAGUAR BASED ON MY CONTENTION THAT THE VEHICLE WAS NEVER PROPERLY FIXED WHEN UNDER WARRANTY RESULTED IN CONTINUAL REFUSALS BY THESE PARTIES WITH CLAIMS BY THE DEALERSHIP THAT A FAULTY TRUCK SEAL AND WATER LEAK THAT CERTAINLY DID NOT EXIST AT 9500MILES NECESSITATED THE COSTLY REPAIRS (THE TRANSMISSION SENSOR IS INSIDE THE SEALED TRANSMISSION). APPROXIMATELY ONE WEEK AFTER THE VEHICLE WAS PURCHASED IN DECEMBER OF 2008, THE CONTACT NOTICED THAT IT WOULD SHIFT ROUGHLY FROM SECOND TO FIRST GEAR UPON DECELERATION. THE VEHICLE WOULD ALSO JERK FORWARD ROUGHLY WHEN ACCELERATING AND DRIVING 15 MPH. HE FOUND NHTSA CAMPAIGN ID NUMBER 04V024000 (POWER TRAIN:AUTOMATIC TRANSMISSION) AND NOTICED THAT IT WAS THE SAME FAILURE THAT HIS VEHICLE WAS DISPLAYING. THE DEALER STATED THAT THE VEHICLE WAS NOT INCLUDED IN THE RECALL; THEREFORE, THEY WERE NOT LIABLE FOR THE REPAIRS. THE MANUFACTURER WAS NOTIFIED AND AGREED WITH THE DEALER. I WAS TRAVELING IN MY CAR AT APPROXIMATELY 30 MPH. I SLOWED FOR A TRAFFIC LIGHT. AS I WAS COMING TO A STOP (RIGHT FOOT ON THE BRAKE), THE ENGINE BEGAN TO REV, THE REAR WHEELS STARTED TO TURN PROPELLING ME FORWARD. I PLACED BOTH FEET ON THE BRAKE, PUSHED THE BRAKE TO THE FLOOR, HOWEVER THE RPM GAUGE WAS MOVING TO MAXIMUM AND THE CAR CONTINUED TO PROPEL ME FORWARD. THE REAR END STARTED SLIDING TO THE LEFT. I SLAMMED THE CAR INTO PARK AND THE TIRES STOPPED MOVING, THE RPMS DROPPED, AND THE ELECTRICAL SYSTEM SHORTED RESULTING IN TAKING THE RADIO OFFLINE AND TO STATION 600 AM. I WAS ABLE TO AVOID THE STOPPED VEHICLE IN FRONT OF ME BY 2 INCHES. THIS IS THE SECOND TIME THIS HAS HAPPENED. THE VEHICLE WAS EVALUATED APPROX 1 MONTH AGO FOR THE SAME TYPE OF FAILURE, BUT THEY WERE UNABLE TO REPRODUCE THE EVENT. OF NOTE, ON DECEMBER 13, 2004, THE VEHICLE WENT INTO REVERSE AND WOULD NOT COME OUT OF REVERSE. THE VEHICLE WAS EVALUATED BY THE DEALERSHIP, THE GEAR SHIFT WAS REPLACED, THE TRANS CABLE BOLT HAD FALLEN OUT, IT WAS REPLACED, AND THE CABLE WAS ADJUSTED. *JB

VEHICLE SPRUNG A BROKEN FUEL LINE SOME TIME IN LATE 2004. VEHICLE REAR BRAKES LOCKED ON FREEWAY RAMP JULY, 2005 TWO WEEKS AFTER DEALER HAD INSTALLED NEW REAR BRAKE PADS. THE VEHICLE HAS TOO MANY DEFECTS IN VARIOUS AREAS FOR A THREE YEAR OLD. MY FEAR IS THAT THERE IS MORE TO SURFACE AND I WILL BE HOLDING A LEMON IN THE VERY NEAR FUTURE.

2003 JAGUAR S TYPE EXPERIENCING PROBLEMS WITH THE EMERGENCY BRAKE ENGAGING WHILE DRIVING.*MR WHEN THE EMERGENCY BRAKE APPLIED, IT CAUSED PREMATURE WEAR OF THE REAR BRAKES AND TIRES. ALSO CONTRIBUTING TO THE PREMATURE WEAR OF THE TIRES WERE PROBLEMS WITH THE REAR END OF THE VEHICLE. THERE WAS A RECALL ON THE EMERGENCY BRAKE, BUT THE DEALER REFUSED TO REPLACE THE REAR BRAKES AND TIRES. THE VEHICLE HAS BEEN IN THE REPAIR SHOP ON 3 OCCASIONS FOR A JERK IN THE TRANSMISSION. PRIOR TO PURCHASING THE VEHICLE, THERE WAS A RECALL ON THE TRANSMISSION, HOWEVER THE DEALER FAILED TO DISCLOSE THE INFORMATION TO THE CONSUMER. THE CONSUMER STATED ONE TIME SHE PLACED THE GEAR INTO DRIVE, BUT THE VEHICLE DID NOT MOVE, THINKING SHE HAD PLACED IT INTO THE WRONG GEAR, SHE LOOKED DOWN AND THE VEHICLE LUNGED FORWARD. *JB
