The contact owns a 2004 Mercedes-Benz E55. The contact stated that upon placing fuel into the gas tank, a strong gasoline odor began to emit from the vehicle. Upon inspection, the contact removed the rear seat and saw that fuel had leaked from the fuel pumps. The contact reached out to the manufacturer through the manufacturer’s website and his request to repair the vehicle was denied. The contact wrote a letter to the manufacturer and the manufacturer denied the repair a second time. The contact stated that the same failure occurred back in 2008 and that the vehicle was repaired under a manufacturer’s recall. The vehicle was not repaired. The failure mileage was approximately 111,000.

MY FUEL TANK HAS DEVELOPED A LEAK WHERE I CAN SMELL FUEL BOTH OUTSIDE AND INSIDE THE VEHICLE AFTER FILLING THE TANK ALL THE WAY. THE ODOR IS VERY PRONOUNCED AND I AM CONCERNED ABOUT THE SAFETY OF THE VEHICLE IF THIS MUCH FUEL IS LEAKING FROM THE TANK. AN INDEPENDENT REPAIR SHOP CONFIRMED A LEAK FROM THE TOP OF THE FUEL TANK. BASED ON INFORMATION I READ ON A MERCEDES BENZ FORUM WEBSITE, IT SAID TO REFERENCE ACTION NUMBER PE12001 (THIS APPEARS TO BE A COMMON ISSUE WITH THIS SERIES OF VEHICLE). NOTICED STRONG FUEL SMELL IN GARAGE AFTER A FILL UP. I AM A MECHANIC SO REMOVED REAR SEAT TO INSPECT FUEL PUMPS, FOUND THE PASSENGER SIDE FUEL PUMP LEAKING QUITE A BIT OF FUEL THROUGH THE ELECTRICAL CONNECTOR BECAUSE HOUSING WAS MELTING AROUND THE ELECTRICAL PINS ALLOWING FUEL TO POOL UP ON TOP OF THE FUEL PUMP. VERY DANGEROUS TO HAVE THESE FUEL FUMES TRAPPED IN THE GARAGE AROUND SO MANY THINGS THAT CAN SPARK. THE FUEL SENDING UNITS UNDER THE BACK SEAT WERE LEAKING FUEL DIRECTLY INTO THE PASSENGER COMPARTMENT. THE FLOOR MATS WERE SOAKED WITH GASOLINE AND THE FOAM INSULATION UNDER THE REAR SEAT, AND THE FOAM IN THE REAR SEAT SOAKED UP GASOLINE FROM THE LEAKING FUEL SENDING UNITS. THE SENDING UNITS WERE REPLACED BY THE MERCEDES DEALER AT A HIGH COST (A LITTLE OVER FOUR THOUSAND DOLLARS). OVER A YEAR LATER, WITH LOTS OF BAKING SODA, ODOR KILLERS, AND LEAVING THE SEAT OUT OF THE CAR WITH A FAN ON IT FOR TWO WEEKS, THE ODOR IS STILL STRONG IN THE CAR. PROBABLY THE ONLY REAL FIX WOULD BE TO REPLACE THE REAR SEAT, THE CARPETING ON THE FLOOR, THE MATS, AND THE INSULATION UNDER THE REAR SEAT. THE COST TO DO SO WOULD BE HIGH. MERCEDES SHOULD RECALL THESE CARS AND OWN UP TO THEIR PROBLEM. I HAVE NO DOUBT THAT ANY SPARK NEAR THE FLOOR OR BOTTOM OF THE REAR SEAT WOULD HAVE CAUSED A MAJOR FIRE. AFTER INSPECTING THE VEHICLE, THE CONTACT DISCOVERED THAT FUEL WAS LEAKING FROM THE FUEL SENDING UNIT AND WAS PRESENT UNDER THE REAR SEATS. THE VEHICLE WAS TAKEN TO THE DEALER. THE TECHNICIAN VERIFIED THE FAILURE AND STATED THAT THE FUEL SENDING UNIT WAS DEFECTIVE AND NEEDED TO BE REPLACED. THE VEHICLE WAS REPAIRED BUT THE DEFECT RECURRED. THE MANUFACTURER WAS NOTIFIED OF THE PROBLEM. THE VIN WAS NOT AVAILABLE. THE FAILURE MILEAGE WAS 67,000.

AS OF FEB 2014 THEY ARE LEAKING AGAIN, MY MAIN CONCERN IS THAT THE FUMES AFTER REPAIRING THE CAR STILL COME BACK, CAUSE MY WIFE TO BE SICK AND AFTER HAVING CANCER SHE HAS NOT ABLE TO USE THE CAR UNLESS WE AIR IT OUT 2-3 DAYS BEFORE. THIS CAR DEVELOPED A VERY STRONG FUEL SMELL INSIDE THE CABIN SHORTLY AFTER FILLING UP WITH GAS IN EARLY 2012. I TOOK IT IN TO THE DEALER AND THEY DID WARRANTY WORK REPLACING SEALS, ETC. A LITTLE UNDER A YEAR LATER THE SMELL CAME BACK. AFTER DOING A LITTLE RESEARCH ONLINE I DECIDED TO TAKE A LOOK UNDER THE BACK SEAT AND FOUND WHERE GASOLINE HAS STAINED THE CUSHIONING AND A CLOTH THAT INSULATES BETWEEN THE FRAME AND THE SEAT. THE FUEL SMELL IS MUCH STRONGER IN THIS AREA, WHICH IS INSIDE THE CABIN. THE DEALER GAVE ME BACK AN ESTIMATE OF ALMOST $2,900 TO REPLACE THE ENTIRE FUEL TANK ASSEMBLY, SENDING UNITS, HOSES, ETC. EVERY TIME I FILL THE GAS TANK THERE IS A STRONG SMELL OF GAS FUMES INSIDE AND OUTSIDE OF THE VEHICLE. IT IS NAUSEATING AND SEEMS WOULD BE DANGEROUS.THE DEALER STATES A TEST VERIFIED A LEAK AT THE LEFT PUMP HOUSING AREA. ADDITIONALLY FOUND STAINING AT THE TOP OF FUEL TANK NEAR CENTER MOUNTING AREA. THEY RECOMMENDED A REPLACEMENT OF THE FUEL TANK ASSEMBLY WITH NEW PUMP AND SENDING UNIT/FILTER ASSEMBLIES. THIS REPAIR IS $3000 US. THE PROBLEM IS THE NEW EQUIPMENT IS THE SAME FAULTY DESIGN OF THE ORIGINAL EQUIPMENT. MOST LIKELY THE SAME PROBLEM WILL OCCUR AGAIN. AFTER CHECKING OUT THE SITUATION I HAVE FOUND THIS IS A COMMON OCCURRENCE WITH THIS MAKE AND MODEL AND THAT THE MANUFACTURER IS AWARE OF THE PROBLEM. *TR

TWO DAYS LATER THE CHECK ENGINE LIGHT DISAPPEARED AND THE CAR THREW A CODE FOR AN EVAP LEAK. I REPLACED THE CHARCOAL CANISTER AND THE GAS CAP THINKING IT MAY HAVE BEEN FAULTY. THE VEHICLE CONTINUES TO THROW A CHECK ENGINE LIGHT WHEN IT IS FILLED WITH GASOLINE. ONCE THE TANK LEVEL DROPS BELOW 3/4 THE WARNING GOES AWAY HOWEVER THE CHECK ENGINE LIGHT REMAINS. *TR

IM WRITING IN REFERENCE TO THE NHTSA ACTION # PE12001. I BOUGHT MY VEHICLE ON THE 23 OF DECEMBER 2012. I CAN HONESTLY SAY I FELL IN LOVE WITH THIS CAR. WITH THAT BEING SAID I HAVE NEVER FILLED THE FUEL TANK OF THIS CAR UNTIL 6-9-2013. THE REASON BEING I HAVE A 1998 FORD F150 THAT I DRIVE AS WELL. I MOSTLY DRIVE THE E55 ON WEEKENDS BUT ITS IN AND AROUND MY NEIGHBORHOOD. MY FATHER JUS CAME BACK FROM THE PHILIPPINES A COUPLE DAYS AGO SO HE NEEDS MY TRUCK TO GET AROUND WHILE HE'S VISITING. SO YESTERDAY I FOUND I NEEDED TO DRIVE THE E55 DAILY WHILE MY FATHER'S IN TOWN SO I FILLED UP THE TANK TO THE CAR. I PUT IN SHELL 91 AND WAITED FOR THE PUMP TO STOP. ONCE STOPPED I REMOVED FUELER AND INSERTED INTO ITS HOLSTER. NOTE I DID NOT TOP OFF FOR I NEVER FELT THE NEED TO IN ANY CAR I HAVE DRIVEN. I PROCEEDED STRAIGHT HOME AND PARKED CAR IN MY GARAGE, CLOSED THE GARAGE DOOR AND WENT IN THE HOUSE. THE E55 WAS IN THERE FOR THE REST OF THE DAY AND NIGHT. AND THEN THIS MORNING AS I WENT INTO GARAGE TO GO TO WORK I WAS JUS TAKEN BACK BY THE FUEL SMELL IN THE ENTIRE GARAGE. SO I OPENED THE GARAGE TO AIR OUT AND CHECKED UNDER THE CAR FOR A PUDDLE OF FUEL BUT FOUND NOTHING. THE SMELL IS MUCH STRONGER NEAR THE REAR OF THE CAR. I DROVE OFF EVEN WITH THE WINDOWS DOWN TO JUS RID THE SMELL AS IT ENTERED THE CABIN AS I STEPPED IN THE CAR TOO. NO PROBLEMS DRIVING TO WORK BUT AS I PARKED IN REVERSE I CAN SMELL FUEL AS THE WIND KICKED IT TOWARDS MY WINDOW. I PARKED AND GOT OUT AND SMELLED AROUND THE BACK AND STILL SMELLED FUEL. SO AS IM WORRIED THROUGHOUT THE DAY AT WORK I WENT INTO MY BENZWORLD FORUM AND FOUND ALOT OF THE SAME COMPLAINTS AS ME ESPECIALLY ON THE W211'S. FUELED THE CAR UP ON MY WAY HOME FROM WORK AND PARKED THE CAR FOR THE NIGHT. IN THE MORNING WHEN I OPENED THE DOOR, THE FUEL SMELL FROM THE INSIDE OF THE CAR JUST ABOUT KNOCKED ME OUT. I IMMEDIATELY OPENED ALL OF THE DOORS TO VENT THE FUMES AS I WAS AFRAID TO START THE CAR UNTIL THE SMELL DISSIPATED. I STARTED THE CAR AND DROVE TO WORK THINKING THAT IT WAS AN ODDITY ONLY TO DISCOVER THAT WHEN THE CAR SAT DURING THE DAY THE SAME THING OCCURRED WHEN I OPENED THE DOOR TO GO HOME FROM WORK. AFTER DOING RESEARCH I HAVE DISCOVERED MANY COMPLAINTS OF THE SAME ISSUE, MOST HAVE STATED THAT THERE IS A DEFECT WITH THE FUEL TANK FILTER-SENDING UNIT AND MERCEDES REFUSES TO ACKNOWLEDGE A PROBLEM EVEN THOUGH SOMEONE COULD PASS OUT FROM THE SELL OF GASOLINE ALONE NOT TO MENTION THE THREAT OF FIRE OR EXPLOSION FROM THE LEAKING FUEL. I DO NOT UNDERSTAND WHY THIS HAS NOT BEEN ADDRESSED AS A RECALL ITEM AS IT SEAMS AS THOU THERE ARE NUMEROUS COMPLAINTS OF THE SAME ISSUE. *TR

SAME SITUATION IDENTIFIED IN PE-12-001. FILLED VEHICLE WITH FUEL AND LEFT SITTING IN DRIVEWAY. THE NEXT DAY, I NOTICED A STRONG FUEL ODOR OUTSIDE OF VEHICLE AND, UPON OPENING THE DRIVER'S DOOR, WAS OVERWHELMED WITH FUEL ODOR. AFTER A QUICK ONLINE SEARCH, I FOUND MULTIPLE REFERENCES TO FUEL FILTER LEAK. I PULLED OUT THE BACK SEAT TO INVESTIGATE AND FOUND THAT THE DRIVER'S SIDE FUEL FILTER ASSEMBLY IS FINE, BUT PASSENGER'S SIDE HAS APPROX 1/2 INCH OF LIQUID FUEL STANDING IN THE FILTER ASSEMBLY. FUEL HAS SOAKED THROUGH THE CARDBOARD/RUBBER COVER AND SOAKED THE INSULATION ABOVE. IT APPEARS THAT THE DRIVER'S SIDE FILTER ASSEMBLY WAS PREVIOUSLY REPLACED (THIS WAS CONFIRMED WITH SERVICE DEPT AT DEALERSHIP. THEY STATE THAT IT WAS REPLACED IN 2008 AS PART OF TSB.), BUT THE PASSENGER'S SIDE, WHICH IS NOW LEAKING, IS OF A DIFFERENT (AND I PRESUME OLDER) DESIGN. I HAVE READ THE RESPONSE FROM HOGAN/LOVELLS DATED 4/19/12 AND WOULD LIKE TO NOTE THAT THE "TIGHT SEAL" DESCRIBED ON PAGE 2 WHICH IS ALLEGEDLY CREATED WHEN THE "ACCESS PORTS" ARE "SECURED BY SIX BOLTS AND [A] GASKET" IS NOT SUFFICIENT TO PREVENT FUEL VAPOR FROM ENTERING THE PASSENGER COMPARTMENT, NOR IS IT SUFFICIENT TO PREVENT LIQUID FUEL FROM SOAKING THROUGH THE GASKET, AND INTO THE INSULATION ON THE UNDERSIDE OF THE REAR SEAT. ONCE THE GASKET AND INSULATION ABOVE IT ARE SATURATED WITH FUEL, THE INTERIOR OF THE CAR IS UNBEARABLE AND PROBABLY A SEVERE FIRE RISK. AFTER REFUELING VEHICLE, I NOTICED A STRONG ODOR OF RAW GASOLINE IN THE INTERIOR OF THE VEHICLE EMANATING FROM THE REAR SEAT AREA. IN JULY, 2011, A MERCEDES DEALERSHIP DETERMINED TWO SENDING UNITS LOCATED UNDER THE REAR SEAT WERE LEAKING, NECESSITATING THEIR REPLACEMENT. THE CAR WAS OUT OF WARRANTY AND THERE WAS NO MENTION OF ANY RECALL OR SERVICE CAMPAIGN RELATIVE TO THE DEFECTIVE PARTS. THE APPROXIMATE COST TO ME WAS $2000.00. JUST LAST WEEK, ON APRIL 6, 2012 THE SAME EVENT OCCURRED WHEREIN I REFUELED THE VEHICLE AND, AGAIN, NOTICED THE SAME GAS ODOR. THIS TIME I ALSO NOTICED FUEL HAD SPILLED ON THE PAVEMENT IN THE VICINITY OF THE RIGHT REAR PORTION OF THE UNDERSIDE OF THE VEHICLE. THE VEHICLE WAS RETURNED TO THE DEALER THAT MADE THE ORIGINAL REPAIRS AND I AM AWAITING THEIR ASSESSMENT OF THE PROBLEM. I HAVE A 2004 MERCEDES AMG E55. I PURCHASED THE CAR SECOND HAND FROM MY NEIGHBOR AT +/-33,000 MILES. ONE WEEK OF OWNERSHIP, I GOT A CHECK ENGINE LIGHT. I HAD ACCESS TO A OBD2 SCANNER AND GOT THE CODE FOR EVAP ERROR. I STORED THE CAR OVERNIGHT IN MY GARAGE AND WOKE UP THE FOLLOWING MORNING WHERE THE WHOLE HOUSE REEKED OF FUEL. I HAD RECENTLY FILLED UP THE NIGHT BEFORE. BEING FAMILIAR WITH THIS MERCEDES VEHICLE I WENT OVER THE FUEL SYSTEM FROM GAS SPOUT TO GAS TANK. THE SMELL WAS COMING FROM INSIDE THE CAR UNDER THE REAR DRIVERS SIDE PASSENGER SEAT. UPON FURTHER INSPECTION AND REMOVAL OF THE SEAT,ACCESS PANEL. I COULD SEE GASOLINE PUDDLING UP ON TOP OF THE FUEL SENDER. I GOT SOME PAPER TOWELS AND DRIED IT. THAT MORNING I BOUGHT A NEW GASKET SEAL FROM THE DEALER TO TRY AND ISOLATE THE PROBLEM. THAT DID NOT HELP...NEXT GAS FILL UP THE CAR CONTINUE TO SMELL LIKE FUEL INSIDE THE CABIN. I TOOK IT TO A INDEPENDENT MECHANIC WHO PERFORMED THE SMOKE TEST TO SEE WHERE THE LEAK IS COMING FROM AND SURE ENOUGH IT WAS FROM THE TOP OF THE GAS TANK WHERE IT MET THE FUEL SENDER. UPON TAKING THE CAR TO THE DEALER, I'VE BEEN TOLD I HAVE TO REPLACE THE ENTIRE GAS TANK, FUEL PUMP, FUEL SENDER AND FITTINGS TO FIX THIS PROBLEM. THE DEALER WANTS ME TO PAY OUT OF POCKET THE ENTIRE COST WHICH IS ABOUT $3,000. THERE STILL IS A EMISSIONS WARRANTY ON THE CAR WHICH IS GOOD UP TO 8 YEARS OR 80,000 MILES WHICH THEY WILL NOT HONOR AS THEY FEEL THIS ISSUE DOESN'T QUALIFY. THEY HAVE JUST LAUGHED AT THE SITUATION AND TRIED TO DOWNPLAY IT. FINALLY MB DIAGNOSED THE ISSUE LATE 2010 AND REPLACED ONE OF THE SENDING UNITS, THE SENDING UNITS WERE ALSO REPLACED UNDER RECALL FOR THIS VEHICLE IN JULY 2008. MB STATED THE CAR WAS NOW REPAIRED BUT AFTER LEAVING THE DEALERSHIP THE CHECK ENGINE LIGHT CAME ON AGAIN. THE CAR HAS NOW FAILED AIR CARE, AN ADDITIONAL EXPENSE. ALL ISSUES RELATE TO FUEL TANK, EVAP VALVE AND DEFECTIVE FUEL SENDING UNITS. HESITATION, CHECK ENGINE LIGHT, ROUGH ENGINE OPERATION FUEL LEAKS AND SMELL. THIS IS CLEARLY A SAFETY ISSUE, FUEL VAPORS ARE COMBUSTIBLE. NOW MERCEDES HAS WASHED THEIR HANDS OF THE ISSUE AND WE (CONSUMERS AND OWNERS OF E55 AMG'S) ARE LEFT TO REPAIR THE PROBLEM AT OUR EXPENSE. THE RECALL CAMPAIGN #2008-020001 IN 2008 HAS RESULTED IN REPEATED FAILURES OF THE SENDING UNITS HOWEVER MERCEDES BENZ IS NOT TAKING RESPONSIBILITY. THERE ARE OVER 40 OWNERS OF THESE VEHICLES ON LINE WITH EXACTLY THE SAME ISSUES. MB USA NEEDS TO ACCEPT RESPONSIBILITY AND RECALL THESE VEHICLES FOR A FUEL CELL SAFETY ISSUE. THERE IS A POTENTIAL FOR COMBUSTIBLE FUEL VAPORS AND I PRAY IT DOES NOT HAPPEN BEFORE MB USA TAKES RESPONSIBILITY. ALTHOUGH THE NUMBER OF OWNERS ARE ONLY APPROXIMATELY 40 AT THIS POINT, THERE MAY BE MANY MORE OUT THERE WITH THE E-CLASS MB FUEL LEAK ISSUE. MB USA NEEDS TO OWN UP TO THE PROBLEM. *TR

I HAD A MERCEDES BENZ E-CLASS RECALL TO REPLACE THE FUEL SENDING UNIT DONE IN 2008 AND A YEAR AND A HALF LATER I STARTED SMELLING GAS INSIDE MY CAR EACH TIME I FILLED UP THE TANK. I IGNORED IT IN THE BEGINNING BUT AFTER A WHILE I GOT THE CHECK ENGINE LIGHT ON. I WAS SURE IT WAS RELATED TO THE GAS SMELL SO I TOOK MY CAR TO THE DEALER FOR INSPECTION, AND THEY SAID THE FUEL SENDING UNIT NEEDED TO BE REPLACED COMPLETELY FOR A COST OF $1200 PLUS LABOR (UNFORTUNATELY I DID NOT BUY THE EXTENDED WARRANTY). I KNOW A CAR MECHANIC IN MY NEIGHBORHOOD WHO DEALS WITH QUITE A LOT OF HIGH END CARS AND CHARGES LESS THAN A THIRD OF WHAT THE DEALER DOES, SO RIGHT AWAY I PICKED UP MY CAR, BOUGHT AN O-RING FOR THE FUEL SENDING UNIT FROM THE DEALER'S PARTS STORE (THANKS TO THE RESEARCH I DID IN A MERCEDES FORUM), AND HAD IT REPLACED BY THE LOCAL MECHANIC I KNOW FOR $50. EVER SINCE, NO MORE LEAKS FOR NOW, BUT I DO THINK THIS IS A TEMPORARY SOLUTION AND IT MAY START LEAKING AGAIN AFTER THE SENDING UNIT'S FUEL CAP OR ITS O-RING STARTS MELTING AGAIN FROM OVERHEATING LIKE SOME OTHER MEMBERS IN THE FORUM MENTIONED. THIS MUST BE A DESIGN FLAW WITH THE CAR AND DEFINITELY NEEDS TO BE TAKEN SERIOUSLY BEFORE SOMEONE ENDS UP LOOSING HIS/HER LIFE. *TR
