I was working for Uber Eats in New Smyrna Beach, FL. The car was front parked and I reversed the car to pull out from the parking lot. I drove at 5 MPH on the parking lot ready to drive to the main road. The main road was two stop signs away. I was halfway to the first stop sign the airbag deployed all of a sudden. There was no car in front of me or behind me. But the airbag impact blew my right arm from the wrist. My right arm was numb and upper right shoulder was bruised.

On September 11th, my wife was involved in a car accident while driving her 2011 Nissan Versa. The collision resulted in the vehicle rolling over and ending up upside down. Shockingly, none of the airbags deployed during this serious incident. A family member recommended that I report this to Nissan, which I promptly did. However, their response, received last Friday, was rather concerning. According to Nissan, the airbags were not designed to deploy in the event of a rollover crash, and they suggested there was no further action to be taken on their end. Today, I consulted with an attorney's office regarding this matter, and they advised me to report the incident to the National Highway Traffic Safety Administration (NHTSA) as a crucial step. Consequently, I am submitting these details to NHTSA to ensure that this incident is properly documented and investigated. upon startup, light illuminates for DRIVER/PASSENGER AIR BAGS OFF. This light intermittently shuts off during driving which tells me something is wrong or not stable with the air bag system even though this VIN has no unrepaired recalls.

NISSAN VEHICLE WAS ON A MAIN CITY ROAD IN MOTION AND THEN SLOWING DOWN TO TRAFFICS CHANGE IN SPEED WHEN REAR ENDED. AS SOON AS VEHICLE WAS REAR ENDED, BRAKES WERE PRESSED TO PREVENT FURTHER COLLISIONS WITH VEHICLES UP FORWARD. MY VEHICLE SEATBELTS FAILED TO RESTRAIN DRIVER AND ALL PASSENGERS WEARING THEM DURING A COLLISION. SEAT BELTS DIDN'T RETRACT UNLESS BRAKES WERE SLAMMED. TWO PASSENGERS IN THE BACK WERE CHILDREN. ONE CHILD HAD A CONVERTIBLE CAR SEAT, SAVING THEM AND FULLY RESTRAINING THEM TO SEAT. SEEMS TO ME THAT INORDER FOR IT ALL TO WORK IT IS THE CLOCK SPRING THAT NEEDS THE RECALL.

I WAS TOLD BY ALL OF MY LOCAL DEALERS THAT MY REQUEST IS NOT FEASIBLE AS THEIR LOANER VEHICLES ARE LIMITED AND INTENDED FOR OTHER PURPOSES. I INFORMED THEM THAT IT WAS THEIR CORPORATE OFFICE WHO OFFERED IT AS A SOLUTION, BUT THEY SAID NO. WHEN ICALLED THEIR CORPORATE OFFICES TO INQUIRE AS TO WHY I WAS ADVISED TO REQUEST A LOANER IN THE MEANTIME, THEY ASKED ME TO BE PATIENT AND WAIT UNTIL THEY'RE READY TO REPLACE THE PARTS. AGAIN, I ASKED WHY THE AFOREMENTIONED SOLUTION WAS INITIALLY OFFERED IF IT WASN'T AN OPTION. I WAS MET WITH THE SAME STATEMENT AND THEIR REPRESENTATIVE STATED THAT TO DATE, THERE HAVE BEEN NO INCIDENTS REPORTED INVOLVING THIS PARTICULAR ISSUE. I ASKED, IF THAT'S THE CASE, HOW WAS YOUR COMPANY MADE AWARE OF THIS SAFETY ISSUE AND I WASN'T GIVEN AN ANSWER. THEY REPEATED THEMSELVES AND OFFERED NO VIABLE SOLUTION. AT THE MOMENT, I NEED THE VEHICLE FOR TRANSPORTATION TO/FROM WORK AND I PRAY THAT I DON'T GET INVOLVED IN ANY TYPE OF ACCIDENT. SINCE THEN, I'VE BEEN RECEIVING SOLICITED CALLS FROM THE DEALERSHIPS REGARDING THE RECALL. HOWEVER, IT'S NOT TO REPLACE THE DEFECTIVE PART(S), IT'S TO PURCHASE ANOTHER VEHICLE AS A SOLUTION TO THE RECALL. IT'S PREPOSTEROUS THAT THE WOULD EVEN CALL REGARDING THE RECALL TO SOLICIT SALES INSTEAD OF ACTUALLY ADDRESSING THE ISSUE.

I PRESENTED MY NOTIFICATION AND IMMEDIATLY SHE CHANGED HER APPROACH. SHE TOLD ME IT WAS TOO LATE AND THAT I NEED IT TO COME BACK. I WENT BACK A COUPLE DAYS LATER AND EARLIER, AT 04:00PM AS SHE REQUESTED. AGAIN, NO ONE WAS ABLE TO HELPED ME GETTING A RENTAL OR SUBSTITUTE VEHICLE. I REQUESTED FOR THEM TO CHECK WITH OTHER NISSAN DEALERS, BUT I JUST GOT A "NO" FOR AN ANSWER: "I AM BUSY, I HAVE TOO MUCH LOAD WORK... ETC" I CALLED MYSELFT TO ANOTHER NISSAN DEALER AND THEY TOLD ME THEY WILL CALL ME BACK IN ABOUT TWO WEEKS, WHEN THEY HAVE AN AVAILABLE RENTAL CAR FOR ME.... UNTIL NOW THAT DEALER HAVEN'T CALL ME YET. I WENT TO A NISSAN DEALER, AND AT THIS POINT I WAS ALL CONCERNED DUE TO MY NEW JOB COMMUTE. FINALLY I FOUND AN ASSOCIATE WILLING TO HELP, BUT I HAVE TO PAID DEPOSIT ($50.00) FOR THE RENTAL CAR AND INCREASED MY INSURANCE PAYMENTS UP $130 MONTHLY PREMIUM (UPDATED TO FULL COVERAGE EVEN AFTER I PAID OFF MY CAR -NISSAN VERSA 2011-) ANY DEALER ASSOCIATE SHOWED CORNCEN FOR THE SAFETY RECALL NOR FOR ANY POSSIBLE FATAL ACCIDENT.

I CALLED THE DEALERSHIP IMMEDIATELY AND THEY AREN'T EVEN STARTING A PARTS WAITING LIST OR SCHEDULING APPTS UNTIL THE SPRING OF 2018 AND THAT NO ALTERNATIVE PARTS (I.E. ON SEPTEMBER 8, 2016, I WAS DRIVING AND ALL OF A SUDDEN THE CAR'S STEERING VIOLENTLY PULLED TO THE RIGHT AND WHEN I TRIED TO CORRECT IT, THE CAR THEN TURNED ALL OF THE WAY TO THE LEFT, CAUSING THE CAR TO ROLL OVER SEVERAL TIMES. ALTHOUGH I HAD MY SEAT BELT ON, THE PRE-TENSIONERS DIDN'T FIRE TO KEEP ME FROM MOVING AROUND AND HITTING MY HEAD. NONE OF THE AIRBAGS WENT OFF EITHER, NOT EVEN THE ONES ON THE DRIVER'S SIDE CURTAIN WHERE THE CAR WAS DAMAGED. AFTERWARDS, I WENT TO THE DOCTOR AND A CHIROPRACTOR BECAUSE I HURT MY BACK, NECK AND MY HEAD. I ALSO GOT A LAWYER BECAUSE I HAD NOT DONE ANYTHING WRONG WHILE DRIVING. THE STEERING PROBLEM JUST CAME OUT OF NOWHERE. NISSAN, TAKATA, TKH AND MY LAWYER INSPECTED THE CAR IN MARCH AND FOUND THAT NONE OF THE AIR BAGS WENT OFF, THE SEAT BELT PRE-TENSIONERS DIDN'T ACTIVATE, THE CAR'S VEHICLE SPEED SENSOR HAD A FAULT CODE, THE CAR'S INTAKE AIR TEMPERATURE SENSOR HAD A FAULT CODE AND NISSAN'S ENGINEER THAT WAS THERE WAS UNABLE TO ACCESS THE POWER STEERING MODULE WITH HIS MACHINE. NEXT, WE FOUND OUT THAT THE ELECTRONIC POWER STEERING SYSTEM CAN SHUT DOWN DUE TO EXCESSIVE STEERING AT SLOW SPEEDS. THAT IS BAD BECAUSE NISSAN HAD A TECHNICAL SERVICE BULLETIN THAT SAID THAT THE CAR CAN PULL TO ONE SIDE EVEN WHEN ALIGNED BASED ON NISSAN'S REQUIREMENTS. THIS MEANS THAT THE REASON PEOPLE HAVE HAD STEERING PROBLEMS IS BECAUSE OF THE CAR'S DESIGN, NISSAN'S ALIGNMENT REQUIREMENTS AND THE CAR NEEDING TO BE ALIGNED DIFFERENTLY. ALSO THE INTAKE AIR TEMPERATURE SENSOR CAN CAUSE A CAR TO SURGE AND SPUTTER, THIS CAN BE WHY PEOPLE HAVE HAD PROBLEMS WITH ACCELERATION. THERE IS NO REASON WHY THE SEAT BELT PRETENSIONERS DIDN'T PROTECT ME. I ALSO BELIEVE THAT THE SPEEDOMETER RECALL MAY BE DUE TO THE VEHICLE SPEED SENSOR PROBLEM. MY HUSBAND WAS EXITING THE INDIANA TOLL ROAD ON THE RAMP TO PAY TOLLS. AS HE WAS DRIVING HIS AIR CONCENTRATOR FELL. WHEN HE REACHED FOR THE CONCENTRATOR HE RAN OFF THE RAMP, HIT A SIGN, THEN BOUNCED BACK HITTING ANOTHER VEHICLE. THE AIRBAGS DID NOT DEPLOY YET HE HIT HARD ENOUGH THAT THE SEATBELTS LEFT VERY CLEAR BRUISING, HIS SHOULDER WAS CAUSING PAIN AS WELL AS HIS LOWER BACK WHICH RECEIVED COMPRESSION FRACTURES FROM THE BELT. HE AS TAKEN TO THE AREA HOSPITAL BY AMBULANCE AND IS IN TREATMENT AS OF TODAY. OUR CONCERN IS THE FACT THAT THE AIRBAGS DID NOT DEPLOY EVEN THOUGH THE FORCE OF THE CRASH COMPLETELY SHATTERED THE WINDSHIELD AND THE FRONT AND REAR ENDS OF THE CAR WERE BADLY DAMAGED CAUSING THE VERSA TO BE A TOTAL LOSS.
