TAKATA RECALL ON WEDNESDAY, OCTOBER 19, 2017 AT 7:40AM, I WAS DRIVING BY MYSELF SOUTH BOUND ON ALABAMA STREET IN HOUSTON, TEXAS. THIS STREET IS A TWO-LANE STREET ON EACH SIDE. I WAS AWARE THAT I WAS ABIDING BY THE SPEED LIMIT, GOING AROUND 25-30 MILES, BECAUSE I HAD JUST LEFT A STOPPED TRAFFIC LIGHT AND WAS HEADING INTO SCHOOL ZONE THAT HAD A FLASHING WARNING LIGHT. ANOTHER DRIVER, DRIVING SOUTH BOUND ON A CROSS STREET OF LIVE OAK STREET, RAN THE STOP SIGN AT HIGH SPEED AND CRASHED INTO ME ON THE DRIVERS' SIDE OF THE CAR. I HAD SEEN THE CAR COMING AND TRIED TO SWERVE AWAY TO THE RIGHT TO NOT HIT HER BUT SHE WAS GOING SO FAST I COULD NOT AVOID HER. THE OTHER DRIVER ADMITTED IT WAS HER FAULT BOTH TO MYSELF, THE POLICE OFFICER WHO ARRIVED ON THE SCENE AND IN THE ACCIDENT REPORT. THE OTHER DRIVERS INSURANCE HAS CLAIMED FULL LIABILITY TO THE ACCIDENT. THE AIRBAG IN MY CAR, THE 2008 SCION XB, DID NOT DEPLOY AT ALL. AS YOU CAN SEE IN THE DOCUMENTATION, IT WAS A DIRECT HIT TO THE DRIVER'S SIDE DOOR AND WAS EXTENSIVE. THE DAMAGE WAS SO EXTENSIVE I COULD NOT OPEN THE DOOR AND HAD TO GET OUT OF THE CAR ON THE OTHER SIDE. IF I HAD NOT BEEN WEARING MY SEAT BELT, I WOULD HAVE BEEN SEVERALLY INJURED. I DO NOT UNDERSTAND WHY THE AIRBAG DID NOT DEPLOY I DID HAVE TO GO TO THE HOSPITAL FOR AN EXAMINATION BUT WAS CLEARED THAT I HAD NOT SUFFERED ANY MAJOR TRAUMA TO THE HEAD OR NECK.

"TAKATA RECALL" WE RECEIVED A RECALL ON OUR TAKATA AIRBAGS THE DAY OF MY ACCIDENT. I CAME TO A STOP ON THE STREET AND ONE CAR WAS GOING TO MAKE A LEFT HAND TURN WHEN I WAS REAR ENDED BY ANOTHER CAR. CAUSING DAMAGE TO ME AND MY PASSENGER. FOR SOME REASON THE AIRBAGS DID NOT DEPLOY. CREATING A DANGEROUS SITUATION EITHER WAY. WE COULD'VE BEEN BOTH SEVERELY INJURED AND THE FACT THAT THEY DIDN'T DEPLOY WE WAS STILL INJURED. I HAVE NEVER BEEN LATE ON A PAYMENT, I BOUGHT THE FULL SERVICE PACKAGE FOR THE VEHICLE AND OUR VEHICLE WAS NEVER FIXED PROPERLY OVER THE COURSE OF 6+ MONTHS THAT TOYOTA HAD THE VEHICLE. NO WE HAVE A VEHICLE THAT WE ARE UNCERTAIN ABOUT DRIVING BECAUSE IT CAN HARM ME, MY WIFE AND MY SON WHILE WE ARE ALL IN THE CAR. WE FEEL THAT THE TAKATA AIRBAGS ARE NOT IN JUST THE PASSENGER SIDE BUT ITS ON THE DRIVERS SIDE AND THE WHOLE CAR. SO WE ARE STILL DRIVING IN FEAR. WE ALSO HAVE A LIMITED EDITION SCION, 849 OF 2500 MADE IN THE US.

MY SON IS DRIVING THIS CAR AND IS 24 SO HE CANNOT HAVE A RENTAL. HE DRIVES ALL THE TIME FOR HIS JOB AND HAS HIS WIFE WITH HIM MOST OF THE TIME. SHE IS NOT GOING TO RIDE IN THE BACK SEAT ALL THE TIME. I HAVE BEEN CALLING TOYOTA OF NORTHBROOK, THE DEALER WE PURCHASED THE CAR FROM, AND THEY HAVE BEEN UNABLE TO PROVIDE ANY INFORMATION AS TO WHEN THIS AIR BAG WILL BE REPAIRED. WE ARE PLANNING A TRIP IN AUGUST 2017 AND NEED EITHER TO HAVE THE AIRBAG REPLACED OR A LOANER AT NO COST FOR THE TRIP.

THE FRONT SEAT PASSENGER SUFFERED INJURIES TO HIS RIGHT HAND, FOREARM, NECK, BACK, AND CHEST. THE REAR DRIVER'S SEAT PASSENGER SUFFERED CONTUSIONS TO HER FACE AND ARM, CHEST AND NECK. MEDICAL ATTENTION WAS REQUIRED AND ALL THE OCCUPANTS WERE TAKEN TO THE HOSPITAL. A POLICE REPORT WAS FILED. THE VEHICLE WAS TOWED FROM THE SCENE. A DEALER WAS NOT CONTACTED. THE MANUFACTURER WAS MADE AWARE OF THE FAILURE AND STATED THAT THEY WOULD OBTAIN THE VEHICLE'S BLACK BOX AND INVESTIGATE THE INCIDENT. THE VEHICLE WAS CONFIRMED TO BE DESTROYED BY THE CONTACT'S INSURANCE. THE APPROXIMATE FAILURE MILEAGE WAS 110,000.

I WAS INFORMED THAT NO REMEDY HAS BEEN FOUND YET. SINCE JUNE 2016 I HAVE RECEIVED NUMEROUS MAILINGS FROM TOYOTA OFFERING TO BUY BACK MY CAR AT A LOW PRICE. IT SEEMS LIKE TOYOTA WANTS US TO EITHER TURN IN OUR CAR FOR A NEW VEHICLE OR WAIT UNTIL THE VEHICLE IS TOO OLD TO FIX. WHEN WILL THIS PROBLEM BE RESOLVED. THE SAFETY RECALL NOTICE FROM TOYOTA HAD BEEN RECEIVED IN MAY OF 2016. IT STATED THAT RECALL HAD BEEN ISSUED FOR TAKATA FRONT PASSENGER AIRBAG INFLATOR. IT HIGHLY RECOMMENDED DO NOT OPERATE THE VEHICLE WITH AN OCCUPANT IN THE FRONT PASSENGER SEAT DUE TO DANGER OF INFLATOR RUPTURE DURING AIRBAG DEPLOYMENT. THIS RUPTURE CAN HAPPENED ANY TIME DUE TO DEGRADATION OF THE PROPELLANT IN THESE INFLATORS AFTER PROLONGED EXPOSURE TO HIGH HUMIDITY AND FLUCTUATING TEMPERATURES. SEVEN MONTHS LATER THERE STILL NO REMEDY HAD BEEN ISSUED. I MADE TWO PHONE CALLS TO TOYOTA CUSTOMER CENTER. FIRST TIME IN OCTOBER 2016 AND SECOND IN JANUARY 2017 AND STILL DID NOT GET ANY REASONABLE ANSWERS ON WHEN THIS RECALL WOULD BE FIXED FOR OUR VEHICLE. TAKATA RECALL - MY COMPLAINT IS THAT I'VE BEEN TOLD NOT TO USE THE FRONT PASSENGER SEAT UNTIL THE AIRBAG IS REPLACED. I CALLED MY TOYOTA/SCION DEALER AND THEY HAVE NO DATE WHEN THE REPAIR CAN BE MADE BUT IT MAY BE MONTHS. SO MEANTIME I'M STUCK WITH A CAR WITH LIMITED FUNCTIONALITY SINCE I CAN'T CARRY A PASSENGER OR EVEN PUT HEAVY OBJECTS ON THE SEAT (AS THAT WOULD ACTIVATE THE AIRBAG).
